1. Introduction and Acceptance

Welcome! This document outlines the rules and conditions ("Terms of Use") for using the "UniversiTest" ("Platform", "Service") provided by "VEBAİMOON Məhdud Məsuliyyətli Cəmiyyəti" (Trading name: WebAIMoon) ("Company", "We", "Us").

By using the Platform (by creating an account or participating in a session), you confirm that you have fully read, understood, and agree to these Terms of Use. If you do not agree with these terms, please do not use the Platform.

2. Description of Service

UniversiTest is a platform that administers digital examinations, tests, and surveys ("Assessment") for universities, independent educators, and educational institutions ("Instructor", "Administrator") to deliver to their candidates ("Student", "Candidate"). The Platform provides a secure and robust environment for authoring content, starting sessions, and analyzing performance metrics. The Platform may provide optional AI-assisted features to help Instructors generate or import test content. These features are user-initiated and assistive only.

3. User Accounts and Responsibilities

Users on the Platform are divided into two classes: Instructors (who register) and Students (who do not register).

Instructor Accounts and Responsibilities:

• To use the full functionality of the Platform, Instructors must register and create an account.
• You are responsible for ensuring that the information you provide when creating an account is accurate and up-to-date.
• It is your responsibility to maintain the confidentiality of your account access. Authentication is handled via third-party identity providers (such as Google), and we do not store user passwords. You are liable for all activities that occur under your account.
• You bear full responsibility for the content of the tests you draft (questions, answers, images, etc.) and for its compliance with copyright laws.

Student (Participant) Responsibilities:

• Students are not required to register on the Platform.
• To participate in a session, you must enter the unique code provided by the Instructor and write your full name in the corresponding field.
• You are responsible for the accuracy of the full name you provide.
• You must adhere to the principles of academic integrity during exams. Cheating, impersonating another person, or any attempt to deceive is strictly prohibited.
• The access code provided to you is personal and should not be shared with others.
• Instructors are responsible for ensuring that the collection and use of student personal data within tests complies with applicable data protection laws. The Platform acts solely as a technical service provider for delivering tests.

4. Prohibited Activities

The following activities are prohibited when using the Platform:

• Posting illegal, abusive, defamatory, obscene, or hateful content.
• Harming the security of the Platform, distributing viruses or malicious code, or attempting to gain unauthorized access to other users' data.
• Impersonating another person or entity.
• Interfering with the normal operation of the Platform or overloading it.

5. Intellectual Property Rights

Platform: The "UniversiTest" name, logo, software, design, and all other components are the property of "VEBAİMOON Məhdud Məsuliyyətli Cəmiyyəti" (WebAIMoon) and are protected by copyright. Copying, modifying, or distributing them without our written permission is prohibited.

User Content: The test content (questions, answers, etc.) created by Instructors belongs to the user who created it. However, by uploading content to the Platform, you grant us a global, non-exclusive license to present that content to your students and to operate the service.

6. Security and Privacy

We implement modern technical and organizational measures to ensure the security of the platform. Account holders (Instructors) are responsible for protecting the confidentiality of their passwords.

7. Limitation of Liability

The service is provided on an "as is" and "as available" basis. We do not guarantee that the Platform will be uninterrupted, error-free, or completely secure. "VEBAİMOON Məhdud Məsuliyyətli Cəmiyyəti" (WebAIMoon) is not liable for any direct or indirect damages resulting from the use of the platform, including but not limited to data loss or business interruption.

8. Changes to Terms

"VEBAİMOON Məhdud Məsuliyyətli Cəmiyyəti" (WebAIMoon) reserves the right to update or change these Terms of Use at any time. You will be notified of changes through the platform. Your continued use of the platform after changes are made constitutes your acceptance of the new terms.

9. Termination of Access

If you violate these terms, "VEBAİMOON Məhdud Məsuliyyətli Cəmiyyəti" (WebAIMoon) has the right to suspend or terminate your access to our services (the account for Instructors, session participation for Students) temporarily or permanently without prior notice.
